How Did the Texas Foster Care Agency Fail This Boy?

The foster care agency, a nonprofit organization on contract with and paid millions by the state of Texas to serve as an exemplary, more efficient foster care system to protect children from abuse, failed this toddler time and time again. During the short time of his placement, he was rushed to the emergency room at a North Texas children’s hospital on three separate occasions.

In addition, records from the toddler’s court-appointed special advocate (CASA), daycare director, family, and neighbors repeatedly warned his foster care case manager and her supervisors that the child was being abused by his placement caregivers. These individuals all contacted the case manager, and his CASA even reported the abuse to the Texas Abuse Hotline. Despite the multiple calls, the case manager did not properly document all the reports, made reckless assumptions, and did not conduct required home visits to check on the toddler personally.

Six days before the toddler died, another report of physical abuse was made to the case manager. This time, the child had substantial swelling that went from his right ear to his right eye. Again, the foster care agency did not act or remove the child from the dangerous placement despite saying it would if signs of abuse continued.
