Child being mistreated by caregiver at daycareAUSTIN, Texas – A central Texas mom has filed a lawsuit against The Children’s Courtyard, located on West William Cannon Drive, claiming severe mistreatment of her 2-year-old son. The lawsuit, filed by The Button Law Firm on behalf of the family, accuses the daycare center of disregarding Texas daycare laws designed to safeguard young children.

What Happened at This Central Texas Daycare?

In July 2023, the child’s father checked on their toddler via the daycare's live surveillance feed during his workday. Shockingly, he witnessed a caregiver attempting to silence the child by smothering him with a blanket during nap time. The caregiver was then observed forcefully slapping the child's face and head multiple times.

Negligent Response and Violations by the Daycare

Upon discovering the abuse, the father promptly notified the daycare’s management. However, The Children’s Courtyard failed to report the incident to state or local authorities as required by law. Instead of taking appropriate disciplinary action, the daycare center suspended the accused caregiver for only one day. It retained her employment despite clear video evidence supporting the parents’ claims of abuse.

Regulatory Findings of Daycare Violations

An independent investigation initiated after the incident substantiated the abuse allegations. The Texas Health and Human Services Commission Child-Care Licensing Division and the Texas Department of Family and Protective Services substantiated multiple violations against The Children’s Courtyard. These violations included physical abuse of a child, use of prohibited punishment tactics, and failure to ensure a safe environment for children.

History of Safety Concerns

Records from The Children’s Courtyard revealed a troubling history, with 56 safety violations documented from June 2019 to May 2024. This extensive history raises significant concerns about the daycare center’s commitment to child safety.
