Disturbing Abuse Caught on Camera

The lawsuit, filed on behalf of three families, was prompted by shocking surveillance footage discovered while searching for a child’s missing shoe. The footage exposed multiple incidents of a daycare worker using violent and unsafe discipline methods, including:

  • Grabbing toddlers by the neck and choking them
  • Berating and shaking a crying child
  • Pushing a child to the floor aggressively
  • Ignoring supervision duties while using a personal cellphone

One parent in the lawsuit reported that her child frequently returned home with unexplained bruises and scratches. Despite state requirements, the daycare failed to document or explain these injuries.

A History of Violations at the YMCA Daycare

State investigations revealed this was not an isolated case. The Texas Health and Human Services Commission and the Texas Department of Family and Protective Services cited the YMCA daycare with 23 violations for failing to follow childcare laws. Investigations also uncovered:

  • Caregivers being responsible for too many children at once
  • Lack of proper caregiver training
  • A daycare director who failed to oversee operations
  • Unsafe practices, including leaving toddlers unsupervised after a fire drill

Despite the clear evidence of mistreatment, the YMCA did not immediately report the abuse to authorities or notify parents. Instead, it allowed the caregiver to remain employed. Eventually, law enforcement intervened, and the caregiver was arrested and charged with multiple counts of injury to a child.
