Previous Lawsuits and a Troubling Pattern of Negligence

AUSTIN, Texas - Milivojevic’s case is not an isolated one. In July 2023, Alexis Dominguez, the mother of the little boy Milivojevic saw mishandled in the recording, also filed a lawsuit against Children's Courtyard. Her complaint has since been amended to include the earlier incident from May. According to Russell Button of The Button Law Firm, the case underscores a troubling pattern of abuse, with caregivers continuing to harm children under the guise of supervision.

Button spoke to MySA about the motivation behind these lawsuits, explaining that they aim to reveal the truth about the caregivers’ qualifications and the management’s failure to prevent harm.

Button emphasized that these cases often involve a lack of training, inadequate supervision, and systemic issues within the daycare. “That’s the evidence we filed the lawsuit for,” Button said, “so we can figure out why and make sure this doesn’t happen again.”

The Daycare’s Troubled Track Record of State Violations

MySA reports that The Texas Health and Human Services Commission has cited The Children's Courtyard in South Austin 25 times for safety deficiencies between October 2018 and March 2023, just two months before the incident involving Milivojevic’s daughter.

Since July 2023, the daycare has received an additional 50 citations, including for unqualified caregivers, use of prohibited discipline tactics, failure to report incidents, and poor hygiene practices. Despite these repeated violations, the daycare’s response has been limited to assurances of corrective actions.

A spokesperson for Children's Courtyard previously issued a statement to MySA, emphasizing their commitment to safety. But as Button points out, actions speak louder than words. He urged parents who have encountered issues at daycares to report these incidents to protect future children from similar harm. “It’s not a matter of if it’ll happen again; it’s a matter of when and how bad,” Button warned.
