vape pensPLANO, Texas - A North Texas mother is suing Bright Horizons at Legacy, claiming her 20-month-old daughter was poisoned by drugs in a vape pen on her first day attending the daycare center in January. This alarming case, highlighted by Star Local Media, highlights the serious allegations of negligence against the daycare.

Star Local Media Highlights Plano Daycare Negligence

Star Local Media has shared further details, saying that on the toddler's first day at Bright Horizons at Legacy, a caregiver noticed the child holding a pink vape pen with smoke coming from her mouth and nose. Despite these obvious signs of distress, the daycare failed to seek immediate medical attention or report the incident to the mother, Jocelyn Carter, or the authorities as mandated by Texas daycare laws.

Drugging Symptoms and Delayed Daycare Response

The lawsuit, as reported by Star Local Media, states that when Carter picked up her daughter, a Bright Horizons at Legacy worker told her the child was "a good sleeper" despite the child's inflamed face. Eight days later, the daycare admitted to Carter that her daughter had managed to get hold of a vape pen. According to the lawsuit, a caregiver took the vape pen from the toddler and confronted another caregiver, who then pocketed the device. The incident was not reported because the caregiver who witnessed it did not know how to report it and feared getting into trouble.

"I am furious that Bright Horizons at Legacy knew my daughter could be poisoned by drugs in a vape pen, but they chose to do nothing and remained silent," Carter said in her statement to Star Local Media. "My daughter is my world. I don't want to imagine what might have happened if I hadn't rushed her to a doctor as soon as I sensed something was off."

Texas State Investigations and Findings

Carter involved the Plano Police Department, whose investigation revealed the toddler could have inhaled up to 40 mg of nicotine from a Lost Mary OS5000 disposable vape pen, according to the lawsuit. The Texas Poison Center Network states that ingesting small amounts of nicotine can be fatal for children. Separate investigations by the Texas Health and Human Services Child-Care Licensing Division and the Texas Department of Family and Protective Services substantiated Carter's claims. These agencies cited Bright Horizons at Legacy for neglectful supervision and failure to meet mandatory reporting requirements.
